Help! My dog was a victim of a hit-and-run by a vehicle. The driver did not stop even if it was clear that my dog was right in front of him! Can the driver be held responsible? What do I do?
PAWS receives numerous reports like this.
First and foremost, we trust that pet owners will rush their dog/cat to a vet right away for treatment of injuries.
If the dog/cat is a stray or has no owner, we trust that concerned citizens who witnessed the incident will take the animal to the nearest vet for treatment of its injuries (kindly ask the vet if a charity rate may be given - or refer to guidelines for stray/rescue emergencies) and foster the animal in your home so it can recover.
First and foremost, we trust that pet owners will rush their dog/cat to a vet right away for treatment of injuries.

Hit-and-run and vehicular incidents can be avoided if pets are kept indoors or secure in the home/property and if they are always on-leash and under the control/supervision of the owner or guardian when outside.
While cruelty to animals is a violation of RA8485, allowing one's pet to roam freely without a leash in public streets or outside your gate or home even in the presence of the owner is also a violation of RA9482 The Anti Rabies Act.
If you wish to file a case against the driver of the vehicle that hit your pet, and there is a witness who will execute an affidavit and evidence (CCTV footage) to show that the driver deliberately ran over the animal and violated RA8485 The Animal Welfare Act, PAWS may offer free review of your affidavit (the witness with personal knowledge or who actually saw the incident should be the one to write the affidavit). Please read our FAQ on how to report animal cruelty thoroughly and email all the info needed and the witness affidavit TO: [email protected] CC: [email protected]
However, please know that although we receive numerous reports like this, PAWS has yet to file animal cruelty cases for hit-and-run cases resting on deliberate intent. This is because, aside from witnesses being reluctant to come forward and execute affidavits, INTENT is one of the hardest things to prove in court. Granted that the driver didn't even step on the brakes, didn't avoid hitting the dog/cat, didn't even stop and get down, didn't show remorse, didn't apologize or didn't offer to rush the dog/cat to the animal hospital or offer to pay for all the hospitalization and medical expenses, it may be reckless imprudence or gross negligence resulting to injury or death and the driver can claim it was an accident and not necessarily animal cruelty. For a case on reckless imprudence or gross negligence, it would be better to consult a private lawyer.
If you are after the driver's apology or if your intent is to claim for damages and you are pursuing the case to get the driver to reimburse you or pay monetarily for the vet bills/treatment or for compensation of the cost of your dog/cat or to replace your dog/cat - we wish to inform you that this is not under the scope of animal welfare and is best settled between both parties through the barangay or police level or you can file a SMALL CLAIMS case instead at your City Hall of Justice.
If ever one decides to file a case based on violation of Sec 6 of RA 8485, do brace yourself to attend court dates that could span several months or even years. If the judge finds the driver guilty, the courts will only hand down penalties limited to what is prescribed under RA 8485/RA10631 The Amended Animal Welfare Act.
